What Is A Notary Public and Why Are Documents Notarized?
A responsible person appointed by a State Government to witness the signing of important documents and administer oaths.
In the State of Arizona a Notary Public is a Commissioned to perform notarial acts.
These notarial acts could include verifying a signature for a variety of documents including real estate deeds, automobile titles, medical power of attorney or other legal documents.
Notarization is required by law for many documents in order for them to be legally binding.
In most cases the Notary will ask to see a current identification document that has a photograph of the person signing that includes their physical description and a signature. Generally a valid driver's license, military ID or passport will be acceptable ID.
Notaries are not responsible for the accuracy or legality of documents they notarize. Notaries certify the identity of the signers. The signers are responsible for the content of the documents.
Notaries are not permitted to give legal advice or draft legal documents or act as a legal adviser unless he or she is also an attorney.
How Is a Document Notarized
For a document to be notarized, it must contain the following:
Text committing the signer in some way.
An original signature (not a photocopy) of the document signer.
A notarial certificate which may appear on the document itself or on an attachment.
The Notary fills in the certificate, signs it, then applies his or her seal to complete the notarization.
What Types of Documents Are Typically Notarized?
There are a variety of documents that are typically notarized; however, any document that requires a legal signature affixed for just about any reason, can be notarized. The notary ensures that the signer is actually the person named on the document and that they have not been forced to sign against their will. Any documents that create a legally binding agreement usually need to be notarized. A few examples of documents needing notarization would be, but are not limited to:

Power of Attorney
Transfer Title of an Automobile
And many other types of documents
Documents are notarized to deter fraud and to validate the identity of the signers. The Notary makes sure that signers have entered into agreements knowingly and willingly. Notaries create a trustworthy environment where strangers are able to share documents with full confidence in their authenticity.
